BYLOCAL NJ LLC ("ByLocal," "we," "us," or "our"), a New Jersey Limited Liability Company located at 4 Lavina Court, Summit, New Jersey 07901, operates the ByLocal mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the App.
By using the App, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the App.
1. INFORMATION WE COLLECT
a) Information You Provide
• Account information: name, email address, and profile photo when you create an account.
• Sign-in credentials: we support Apple Sign-In, Google Sign-In, and email/password authentication. We do not store your Apple or Google passwords.
• City and interests: the community and interest categories you select during onboarding.
• Business information: if you register a business, we collect business name, address, phone number, website, social media links, description, and operating hours.
• Transaction data: when you purchase tickets, gift cards, memberships, or make donations, we collect order details and delivery addresses.
• User-generated content: posts, announcements, images, and other content you create within community groups.
• Communications: when you contact us via email for support.
b) Information Collected Automatically
• Device information: device type, operating system, and unique device identifiers for push notifications.
• Usage data: screens visited, features used, and interactions within the App for analytics and improvement purposes.
• Location data: we collect the city you select. We do not continuously track your GPS location. If you use the "Find My Location" feature during onboarding, we request one-time access to determine your nearest city.
c) Information from Third Parties
• If you sign in with Apple or Google, we receive your name and email address from those services as authorized by you.
2. HOW WE USE YOUR INFORMATION
We use your information to:
• Provide, maintain, and improve the App and its features.
• Process transactions, including ticket purchases, gift card sales, membership subscriptions, and donations.
• Send push notifications about events, group updates, and order status (with your consent).
• Personalize your experience based on your selected city and interests.
• Communicate with you about support inquiries, updates, and important notices.
• Detect, prevent, and address fraud, abuse, and technical issues.
• Comply with legal obligations.
3. HOW WE SHARE YOUR INFORMATION
We do not sell your personal information. We share information only in these circumstances:
a) Service Providers
• Firebase (Google LLC): authentication, data storage, file storage, and push notifications. Google's privacy policy: https://policies.google.com/privacy

b) Business Partners
When you interact with a local business through the App (e.g., placing an order, purchasing a ticket, or joining a membership), the relevant business receives your name, email, and transaction details necessary to fulfill your request.
c) Legal Requirements
We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency).
d) Business Transfers
If ByLocal is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
4. DATA RETENTION
We retain your personal information for as long as your account is active or as needed to provide you services. If you delete your account, we will delete your profile information. Some data may be retained in anonymized form for analytics, and transaction records may be retained as required by law (e.g., tax and financial recordkeeping requirements).
5. DATA SECURITY
We implement industry-standard security measures to protect your information, including:
• Encryption in transit (TLS/HTTPS) for all data transmitted between the App and our servers.
• Encryption at rest for data stored in our database.
• Secure authentication through Firebase Auth with support for Apple and Google sign-in.
• Access controls limiting who can access user data.
However, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.
6. YOUR RIGHTS AND CHOICES
a) Account Deletion
You can permanently delete your account and associated data at any time through the App's Settings screen (Settings > Delete Account). Upon deletion, your profile, preferences, and personal data are removed. Transaction records may be retained in anonymized form as required by law.
b) Push Notifications
You can disable push notifications at any time through your device's system settings.
c) Location
The App uses city-level location only. You can change your selected city at any time in Settings.
d) California Residents — CCPA Rights
If you are a California resident, you have the right to:
• Know what personal information we collect, use, and disclose.
• Request deletion of your personal information.
• Opt out of the sale of personal information (we do not sell personal information).
• Non-discrimination for exercising your privacy rights.

e) Other State Privacy Rights
Residents of Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws may have similar rights. Contact us at privacy@bylocal.app to exercise them.
7. CHILDREN'S PRIVACY
The App is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected information from a child under 13, we will promptly delete it. If you believe a child under 13 has provided us personal information, please contact us at privacy@bylocal.app.
8. THIRD-PARTY LINKS
The App may contain links to third-party websites or services (e.g., business websites, social media pages, external ticket sellers). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies.
9. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised policy.
