1. Who we are
BYLOCAL NJ LLC ("ByLocal," "we," "us," or "our"), a New Jersey limited liability company, operates the ByLocal mobile application and website (the "Platform").
2. Acceptance
By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
3. The Platform
ByLocal connects users with local businesses, events, community groups, causes, jobs, products, and services. Unless expressly stated otherwise, third-party businesses and organizers are responsible for their listings, products, services, fulfillment, refunds, and content.
4. Accounts
You must provide accurate information and protect your credentials. You are responsible for activity under your account. You may delete your account from the app.
5. Purchases and payments
Payments are processed by Stripe. Prices, platform fees, delivery terms, cancellation terms, and refund conditions are shown before purchase when applicable. ByLocal does not store complete payment-card numbers.
6. User content
You retain ownership of content you submit and grant ByLocal a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it as needed to operate and promote the Platform. You must have the rights to submit that content.
7. Prohibited conduct
You may not use the Platform unlawfully, fraudulently, abusively, to violate another person's rights, or to interfere with security or operation.
8. Third-party services
The Platform uses services including Firebase, Google Maps, Stripe, Apple Sign-In, Expo, Sentry, and Meta. Their own terms and policies may also apply.
9. Disclaimers and liability
The Platform is provided on an "as available" basis to the fullest extent permitted by law. ByLocal is not responsible for third-party goods, services, listings, or external sites. Liability is limited to the fullest extent permitted by applicable law.
10. Changes and termination
We may update these Terms or suspend accounts that violate them. Material changes will be communicated through the Platform or other reasonable means.
11. Governing law
These Terms are governed by the laws of the State of New Jersey and applicable United States law, without limiting non-waivable consumer rights.
